Terms of Service for Brightylo

1. Introduction

Welcome to Brightylo, a creative agency operating under the domain brightylo.com. These Terms of Service (“Terms”) govern all transactions and interactions with our clients and visitors. Effective year 2025.

2. Services

Brightylo provides design, branding, marketing strategy, web development and other creative solutions (“Services”). All project specifics are outlined in a separate proposal or agreement. Clients agree to provide required materials and feedback in a timely manner.

3. Info Products

Brightylo offers digital courses, templates and guides (“Info Products”). Access details and usage rights are provided upon full payment. Info Products are for personal or commercial use as specified at purchase. Redistribution is prohibited.

4. Goods

Brightylo may offer physical goods such as branded merchandise (“Goods”). Shipping costs and timelines are provided at checkout. Risk of loss passes to the client upon dispatch from our warehouse. Custom or personalized Goods may have special terms.

5. Refunds and Rescheduling

5.1 Creative Services

Requests for refund of Service fees must be submitted in writing at least 72 hours before the scheduled start date. If approved, 50% of the paid amount will be refunded. Requests made less than 72 hours before commencement are not eligible for refund. Instead, clients may reschedule the Service once without additional charge if the request is received at least 72 hours in advance. After delivery of final assets, no refund requests will be accepted.

5.2 Info Products

Clients may request a refund for Info Products within 14 days of purchase, provided they have not downloaded or accessed the materials. Once access is granted, the product is considered delivered and is not eligible for reimbursement. Approved refund requests are processed within 7 business days.

5.3 Goods

Clients may send back Goods for refund within 30 days of delivery if items are unused and in their original condition. Clients must notify us via email prior to shipment. Shipping costs for the shipment back are the client’s responsibility unless the item is defective or damaged. Upon receipt and examination, we will process the refund within 10 business days.

5.4 Refund Processing

All approved refunds will be processed via the original payment channel. Processing times may vary depending on the provider, but typically occur within 7 to 10 business days from approval.

6. No-Refund Services

Certain Services, including strategic consulting sessions and hours sold in advance, are sold on a no-refund basis due to the immediate allocation of resources and personnel. This policy is necessary to ensure availability and fair scheduling for all clients.

7. Disclaimer of Warranties

Brightylo provides Services “as is” without any warranties. We do not guarantee specific outcomes or results. Clients bear responsibility for compliance with local laws and regulations.

8. Limitation of Liability

Brightylo’s liability is limited to the amount paid for the specific Service, Info Product or Goods in question. Under no circumstances shall Brightylo be liable for indirect or incidental damages.
